Terms & Conditions

• You must be at least 16 years old to create an account, or have parental/guardian consent
• For apps designed for children (e.g., WordWiz), a parent or guardian must create and manage the account on behalf of the child
• By creating an account, you represent that the information you provide is accurate and complete
• You must have the legal capacity to enter into a binding agreement

• You may register using email/password or third-party authentication (e.g., Google Sign-In, Apple Sign-In)
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must notify us immediately at support@eywasoft.co.uk of any unauthorised use of your account
• We reserve the right to suspend or terminate accounts that violate these Terms
• We use Firebase Authentication to securely manage your credentials — we never store passwords in plain text

When using our Services, you agree not to:

• Use the Services for any unlawful purpose or in violation of any applicable laws
• Submit content that is offensive, harmful, threatening, abusive, defamatory, or otherwise objectionable
• Attempt to gain unauthorised access to our systems, networks, or other users' accounts
• Interfere with or disrupt the Services, servers, or networks connected to the Services
• Reverse engineer, decompile, disassemble, or create derivative works from any part of our applications
• Use automated systems (bots, scrapers, crawlers) to access the Services
• Impersonate any person or entity, or falsely state or misrepresent your affiliation
• Upload malicious code, viruses, trojans, or any harmful data
• Collect or harvest personal information of other users

Violation of this policy may result in immediate suspension or termination of your account.

Our Content: All content within our applications — including but not limited to text, graphics, logos, icons, images, audio, software, and design — is the property of EywaSoft UK Limited or its licensors and is protected by UK and international copyright, trademark, and other intellectual property laws.

Your Content: You retain ownership of content you create within our apps (e.g., written stories, notes). By submitting content for AI evaluation or processing, you grant us a limited, non-exclusive licence to process that content solely for the purpose of providing the requested service (e.g., generating feedback on your writing). This licence terminates when you delete your account.

Feedback: Any feedback, suggestions, or ideas you provide about our Services may be used by us without obligation to you.

Trademarks: "EywaSoft", the EywaSoft logo, and our app names are trademarks of EywaSoft UK Limited. You may not use them without our prior written consent.

Some of our applications use artificial intelligence (AI) services (including Google Gemini and OpenAI) to generate content, including but not limited to:

• Writing feedback and evaluation scores
• Audio narration of feedback (text-to-speech)
• Educational content suggestions and recommendations

You acknowledge and agree that:

• AI-generated content is provided for educational and informational purposes only
• AI-generated scores and feedback are approximations and should not be relied upon as definitive assessments
• We do not guarantee the accuracy, completeness, or appropriateness of AI-generated content
• AI-generated content should be reviewed by a parent, guardian, or educator when used by children
• Your content submitted for AI processing is not stored by third-party AI providers for model training

Some features of our applications may require a paid subscription or one-time purchase. If applicable:

• Subscription fees are billed through the Google Play Store or Apple App Store
• Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period
• You can manage and cancel subscriptions through your Google Play or Apple ID account settings
• Refunds are handled according to the respective app store's refund policy (Google Play / Apple)
• We reserve the right to change subscription pricing with reasonable notice
• Free trial periods, if offered, convert to paid subscriptions unless cancelled before the trial ends

Our Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Implied warranties of merchantability or fitness for a particular purpose
• That the Services will be uninterrupted, timely, error-free, or secure
• That any defects will be corrected
• That the Services are free of viruses or harmful components
• The accuracy or reliability of any information obtained through the Services

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

To the maximum extent permitted by applicable law, EywaSoft UK Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of data, content, or user-generated materials
• Loss of profits, revenue, or business opportunities
• Loss of use of the Services
• Any damages arising from your use of or inability to use the Services
• Any damages arising from unauthorised access to your account

Our total aggregate liability for any claim arising from these Terms shall not exceed the greater of: (a) the amount you paid us in the 12 months preceding the claim, or (b) £100.

You agree to indemnify, defend, and hold harmless EywaSoft UK Limited, its officers, directors, employees, contractors, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable legal fees) arising from:

• Your use of or access to the Services
• Your violation of these Terms
• Your violation of any third-party right, including intellectual property or privacy rights
• Any content you submit or transmit through the Services

• You may terminate your account at any time by following the account deletion process
• We may suspend or terminate your access to the Services immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties
• Upon termination, your right to use the Services ceases immediately
• We will delete your data in accordance with our Privacy Policy
• Sections that by their nature should survive termination (including Intellectual Property, Disclaimer, Limitation of Liability, Indemnification, and Governing Law) will survive

We reserve the right to modify these Terms at any time. We will notify you of material changes through our applications, by email, or by posting a notice on our website. The "Last updated" date at the top of this page indicates when these Terms were last revised.

Your continued use of the Services after such notification constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Services and delete your account.

These Terms are governed by and construed in accordance with the laws of England and Wales.

Any disputes arising from or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If you are a consumer in the European Union, you may also be entitled to use the European Commission's Online Dispute Resolution platform.

Severability: If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Entire Agreement: These Terms, together with our Privacy Policy and any app-specific terms, constitute the entire agreement between you and EywaSoft UK Limited regarding the use of our Services, superseding any prior agreements.

Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
